Bigonus ("We," "Us," "Our," or "Platform") is committed to maintaining a premium curated marketplace that respects the intellectual property rights of others. We expect our users (including buyers and sellers/vendors) to do the same. This Intellectual Property & DMCA Policy outlines our policies regarding intellectual property, including how we handle claims of copyright infringement under the Digital Millennium Copyright Act ("DMCA").
This policy is part of our Terms of Service and Marketplace Vendor Agreement.
1. OUR INTELLECTUAL PROPERTY
The content on the bigonus.com website, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, software, and the overall "look and feel" of the Platform, is the property of Bigonus LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. Bigonus and other marks indicated on our site are trademarks or registered trademarks of Bigonus LLC in the United States and/or other countries.
You may not use our trademarks, service marks, trade dress, or other intellectual property in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Bigonus without our express prior written consent.
2. VENDOR AND USER CONTENT
Sellers/Vendors are responsible for ensuring that the content they upload to the Platform does not infringe upon the intellectual property rights of third parties. As a platform focused on premium quality, we take IP violations seriously to protect the integrity of our curated collection.
Users who submit reviews, comments, or other content grant Bigonus a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use such User Content as outlined in our Terms of Service.
3. POLICY ON INFRINGEMENT
It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA. We may remove content and/or terminate accounts of users who are repeat infringers.
4. DMCA COPYRIGHT INFRINGEMENT NOTIFICATION PROCESS
If you believe your copyright has been infringed, please submit a notification with the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material (e.g., URL).
- Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

6. COUNTER-NOTIFICATION PROCEDURE
If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification with the following information:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
7. TRADEMARK AND OTHER IP COMPLAINTS
To submit a claim regarding trademark infringement or other intellectual property violations (other than copyright), please send an email to support@bigonus.com with:
- Identification of the intellectual property right claimed to be infringed.
- Identification of the material claimed to be infringing.
- Your contact information.
- A statement of good faith belief that use of the material is not authorized.
- A statement made under penalty of perjury that the information is accurate.
- Your signature.
8. REPEAT INFRINGER POLICY
Bigonus reserves the right to terminate the accounts of users or vendors who are repeat infringers of intellectual property rights.
9. MODIFICATIONS
We may modify this Intellectual Property & DMCA Policy at any time. We will post the revised Policy on this page and update the "Last Updated" date above.
